For the Women Defenders of Mother Earth (Frente de Mujeres Defensoras de la Pachamama) 26/11/2010. If the mining mandate had been applied none of these companies would have their concessions, however they are at ease because they have the backing of a Government that is in bed with the foreign invaders and the national mining mafia and that is why the Mandate was not applied. The mandate clearly states that they were to become extinct without any financial compensation for the concessions of any company that had not fulfilled the process of consultation with the communities as it had been established in the previous Constitution. But some people will say: -” Well, what are we going to do now?". The Government says that mining will on anyway, and it will be better to see how we can profit from it". This type of mentality is what lets them continue to crush us more and more every day, and those who violate our rights continue to enjoy impunity. It seems that we don’t realize the seriousness of the situation. The mining companies have been and continue to rape and violate the National Constitution. The mining companies laugh in the face of a Constituent Assembly said to have "full powers". They have wiped their... shoes with our supreme system of laws and authority powers, so what else can we expect but for the mining companies to impose "their own laws" above the laws of our ministries and of El Ecuador. This means that we are at their mercy, which is extremely serious because there is no justice left in this country. An institution that has to be respected is the Public Defender's Office of Ecuador, which is supposed to guarantee the rights of the citizens of this country. For the mining companies and the corresponding ministries the writing is on the wall. The Resolution 79-CNDHIG-Exp-No.40821-2009, obtained thanks to the pressure of organizations and communities of the National Coordinator for the Defense of Life and Sovereignty (CNDVS), is losing its role of importance since it was issued a year ago because no one is paying attention to any of the recommendations made in the resolution. As the Mining Mandate states: In order to safeguard the collective rights of indigenous peoples and communities such as the right to housing, to live in a healthy environment, and rights to Nature;Considering the objectives of the Constituent Mandate No. 6, the so-called " The Mining Mandate", especially clause 4 which expects that exploration and mining exploitation will be conditioned "to the preservation of the environment and respect for the human rights of indigenous peoples, Afro-Ecuadorian and communities involved directly or indirectly in this activity..." recommends that: 1) The Ministry of Mines and Petroleum implement the Mandate Constituent No. 6, according to provisions of Arts. 11 and 12, with a strong emphasis on: a) Art. 1, previous environmental consultation with specific indigenous communities; b) Art. 3, protection of forests, its areas and buffer zones; c) Art 4, prevent hoarding of mining hectares by the same individual, legal entity or companies greater than 3; Special attention to concessions granted to the companies involved in non-complying cases with the Mining Mandate, as reported by CNDVS: Corrientes Resources Inc.; Kinross Gold Corporation; International Mineral Corporation (IMC); IAMGOLD
So many provisions are not being respected but above all the ADRCM (the Decentralised Agency for Regulation and Control of Mining) is now charging a fee for giving information about mining concessions. However it is stated in the above-mentioned Resolution 79, that: "It is also recommended that access to this information is not to be subject to the payment of administrative fees, because the cost would prevent that those affected by mining activity (indigenous, peasant communities, the general public), from exercising their right of access to public information."
Furthermore, the persecution and criminalization of our struggles has been going on for years, such as the unfair judicial process of Lina Solano Ortiz accused of "invasion of private property" by Corriente Resources. This unfounded case begun in 2007 and no new evidence or proof for these ridiculous accusations, however the Public Prosecutor's Office of Méndez continues course to the process.
And the “Government of the Civic Revolution" is covering up all these abuses with the crumbs thrown at us, as if we were hungry street dogs: federal stocks and bonds, and other "shiny instruments", which are only the leftover bones because the meat… the meat on the bone was all carved out and eaten up by the multinational companies, they have all the best cuts of the meat.
We must open our eyes and search for ways to stop the atrocities to our human, constitutional and environmental rights, before it is too late.

Every day we are witnesses to extraordinary scandals in our country. Mining companies are picking up where they left off, corrupting the will of our people with cheap knick-knacks; people dying of hunger all over our country, and they sell themselves for less than a plate of lentils, and no one has yet to answer for the unconstitutional delivery of concessions and the shameless lack of respect for the MINING MANDATE.
